Probate & Administration

Probate & Administration:

Probate: Probate is the process whereby the Supreme Court confirms that the Will of a deceased person is valid and approves the authority of the Executor to administer the Estate.  Not all estates require probate. Whether a Will requires probate will depend on a number of factors, including what assets are held by the Estate at the time of the deceased’s death and how those assets may be released

We provide advice with respect to deceased estates and can advise you whether an astate requires Probate or may be dealt with informally.

Administration: Estate administration is the process of distributing the assets of a deceased person’s estate to their beneficiaries. This task is carried out by the executor of the estate who is named in the deceased’s will.

When a person dies without a Will or there is a problem with the Will then the task of administration of the estate may only be carried out by a person(s) obtaining a Grant of Letters of Administration from the Supreme Court in NSW.

Clarke Law can help you navigate your way through the various legal and practical considerations involved with estate administration, from basic estate administration through to complicated matters associated with determining whether you need to obtain Letters of Administration in NSW.

Today, we are seeing that disputes about wills and deceased estates are occurring more frequently. Contested will disputes are often quite complex and stressful. Whether you are seeking to challenge a will or you are an executor or Administrator of an estate being challenged, Clarke Law can provide quality and sensitive legal assistance.

If you wish to challenge a Will it is important to get immediate legal advice as there are time limits in which a challenge may be made. In NSW, it is 12 months from the date of death.
