Probate: Probate is the process whereby the Supreme Court confirms that the Will of a deceased person is valid and approves the authority of the Executor to administer the Estate. Not all estates require probate. Administration: Estate administration is the process of distributing the assets of a deceased person’s estate to their beneficiaries. This task is carried out by the executor of the estate who is named in the deceased’s will.
When a person dies without a Will or there is a problem with the Will then the task of administration of the estate may only be carried out by a person(s) obtaining a Grant of Letters of Administration from the Supreme Court in NSW.
